A Cumby police officer reportedly stopped a Dodge Avenger at 1:47 a.m. Aug. 22 between the 109 and 110 mile markers on Interstate 30. The driver was identified as a 30-year-old man and the passenger as a 55-year-old man. The Cumby officer, in arrest reports, alleged he suspected the pair to be engaging in criminal activity. The driver allegedly kept changing his story each time the officer asked about the pair’s travel plans. This make the officer suspect he was lying. The passenger also gave travel plans that differed from those given by the driver.

When asked, the 30-year-old driver reportedly refused to let the officer search the car. The officer advised he would be calling for a police K-9 and was detaining them in handcuffs for his safety as well as the man’s. He conceded and was placed into handcuffs without incident, the Cumby officer alleged in arrest reports.

When police attempted to place the passenger into handcuffs, however, the man “resisted by forcefully pulling away from me,” the Cumby officer alleged in arrest reports. When the police sergeant attempted to grab the man, he resisted then tried to run from the officer, arrest reports stated.

Thus, the Cumby officer alleged he deployed his Taser and tased the man multiple times before he eventually complied with verbal commands and stopped resisting police efforts. The Cumby officer stated he waited for additional law enforcement to arrive to assist before again attempting to place the man into custody. A Hunt County officers was the first to arrive; the man was then placed into custody, according to reports.

Cumby’s police chief then arrived and had his police canine conduct a free air sniff search around the car; the dog gave multiple positive alerts, which lead to a probable cause vehicle search, according to arrest reports.

When police found no illegal contraband in the black car, he released it and the driver. The passenger, however, was taken to jail.

At the jail, the man identified himself by the same first name and date of birth but reversed his last names. A short time later, jailers advised they had found a Social Security card in the man’s possession with an entirely different name. When the officer asked the man if he’d given him a false name previously he told them he was the man named on the card. He then gave a date of birth that would make him 45 years old, not 55.

A records check by dispatchers, however, showed no information for a person by that name and date of birth. A records check using the Social Security number showed it did not match the name and information given either, according to arrest reports.

Cumby police alleged Immigration and Customs Enforcement officials were contacted and advised they would respond at Hopkins County jail to investigate the man’s identity. The man was held in jail for failure to identify by giving false or fictitious information and for resisting arrest, search or transport, Cumby police noted in arrest reports.

The man was later identified and booked into the jail on both misdemeanor charges at 5:04 a.m. Aug. 22 under yet another name and date of birth, that’d make him a 57-year-old Dallas resident. The man remained in the county jail Friday morning, Aug. 23, on $2,000 bond on the resisting arrest, search or transport Charge and $1,000 on the failure to identify charges, according to jail and arrest reports.

City of Como Announces Plans For VFD, Building

The Como Mayor has announced plans for a city public safety department, which includes putting the volunteer fire department back into service and starting a city police department and updating a city building to serve as a community center.

Como City Council following a special meeting Friday afternoon announced plans for Como Volunteer Fire Department and hat the building at 299 Gaskins St. will be updated to serve as a community center.

Como VFD was officially taken out of service per Hopkins County Fire Marshal’s Office Friday afternoon, Aug. 16, pending administrative review. The order followed an investigation by the county fire marshals and Texas Rangers that resulted in the arrest of Darren Dwayne “Bro” Harris, 53, and Roy George Darby, 78, on one felony charge each alleging theft of funds from the department.

Harris had served as CVFD’s chief until the investigation was launched; his duties were reportedly suspended at that time pending the investigation. Darby was a long-time member and served as secretary/treasurer. Because fire department members are considered public servants, the felony theft charge was enhanced, the fire marshals said following Harris and Darby’s arrests on Aug.16.

On Aug. 18, Como Mayor Darla Henry, on the City of Como Facebook page, assured residents that the city was working with other county officials to develop a plan for CVFD, and that the area will continue to receive fire and emergency services coverage from Hopkins County and the surrounding volunteer fire departments until that plan is in place.

The city had taken possession of the fire department building at that time.

“For the time that I have been in Como (8 years) the Como VFD has not been under the governance or authority of the Mayor or Council. They have been separate and apart from City Hall. However, that has now changed,” Henry posted on Aug. 18.

The city’s plan is not only to get the fire department up and running “in just a few days,” but to also once it is to have a police department for code enforcement and to update the building to serve as a community center.

Applications are being accepted for “qualified volunteers” interested in donating their time as members of Como’s fire department, which will become part of “Como Department of Public Safety – Police and Fire,” Henry reported late Friday night.

Applications for volunteer firefighters are available at Como City Hall. Code Enforcement Officer Andy Lowen was appointed director of public safety to “oversee the building and all that goes on,” including serving as interim fire chief. Matt Green was appointed assistant fire chief.

Working under the mayor and city council, Lowen will continue to oversee the building once the department is reestablished, then will focus on a police department, according to Henry’s Aug. 23 post on the City of Como Facebook page.

“In the coming days and weeks hopefully you’ll begin to see some basic changes of signs and logos. Our goal is to purchase the equipment we need and staff the Fire Dept with enthusiastic, trained and qualified young men and women that will dedicate their time to keeping Como and its’ residents safe,” the mayor posted.

Henry stated that when the Como Police Department is established, it won’t be staffed 24 hours a day, 7 days a week. It will focus mostly on code enforcement during the day. Hopkins County Sheriff’s Office continuing to serve other law enforcement needs after hours and as needed during the day.

Cumby City Hall, 100 East Main Street, Cumby, Texas

Cumby residents who signed up for the new alert system were notified by call, and others learned via Facebook post to avoid Main Street at Commerce Street for a few hours Monday afternoon.

Emergency officials were alerted at 12:55 p.m. Aug. 26 that a vehicle hauling 5-gallon buckets of hydraulic oil had spilled approximately 15-20 buckets all over the road. City officials utilized the new alert system to let people know the road would be closed until the spill was cleaned up by a local towing service’s hazardous materials response unit, and a Cumby police officer stood by as well, according to county reports.

On the City of Cumby Facebook page, Place 5 Alderman Julie Isham Morris at 1 p.m. Monday posted: “Please avoid the downtown at this time! There has been an accident with a truck loosing his load. 911 has been contacted.”

He was transported to the hospital for an injury allegedly sustained during the physical altercation, according to police.

Sulphur Springs police dispatchers reportedly received a report of what sounded like a gunshot being fired at a West Park Street residence early Wednesday afternoon.

“The victim’s estranged boyfriend forced entry to the residence and the victim was assaulted. During the commission of the assault, the defendant was injured. DNA evidence was left at the scene,” a Sulphur Springs police detective said Wednesday afternoon.

Neither person involved was believed to have sustained life-threatening injuries during the altercation, according to police.

The estranged boyfriend, identified by police only as a Hopkins County man who had yet to be formally charged with any offenses Wednesday afternoon, allegedly took the victim’s vehicle without permission. Police reportedly spotted the vehicle and a short vehicle pursuit ensued, ending when the vehicle crashed in the Helm Lane area. Police were reportedly dispatched during the noon hour to the 300 block of West Park Street just, where someone was reportedly heard screaming for help in a residence, the officers alleged in arrest reports. Initial police reports were that a loud noise that sounded like a gunshot was also reported.

While en route, officers received information that the suspect, Beachem, had assaulted the homeowner, then stole her vehicle, a maroon Toyota Camry.

Officer Hawkins reportedly spotted the car and attempted to stop it at the E-Z Mart store on Helm Lane at East Shannon Road. Beachem allegedly took off in the woman’s car when the officers turned on the lights on his patrol vehicle. Beachem allegedly wrecked the car in the nearby Quail Ridge Apartments parking lot and fled on foot.

After a search, Beachem was located and taken into custody. Police Wednesday reported he had forced entry into the residence where he was found.

Instead of being taken directly to jail, Beachem was reportedly transported to the hospital to have medical treatment for injuries that occurred during the West Park Street disturbance.

Police alleged the man had assaulted the West Park Street homeowner. He allegedly kicked in the back door of her residence, and choked her and punched her in the face and head area multiple times with a closed fist, Hawkins and Mayes alleged in arrest reports.

Beachem was allegedly injured during the physical altercation, leaving DNA evidence at the West Park Street residence before taking off in the woman’s car, a police detective reported Wednesday.

Once released from the hospital, Beachem was jailed on all three felony charges. He remained in the county jail Thursday morning. Bond was set at $100,000 on the first-degree felony burglary with intent to commit another felony charge, $50,000 on the third-degree felony evading arrest charge and $25,000 on the felony unauthorized use of a motor vehicle charge, according to jail reports.

The arrest marks the third time Beachem has been arrested and jailed locally this summer, and fifth time since July of 2018. He was arrested for public intoxication on Aug. 18, and PI and possession of drug paraphernalia on Aug. 24, 2019, according to jail reports.

Beachem was arrested on July 5, 2018, for public intoxication and criminal mischief; and on Aug. 12, 2018, for aggravated assault of a date, family or household member with a deadly weapon, criminal mischief, evading arrest or detention, and violation of parole.

The August 2018 charges stem from an incident in which Beachem allegedly rammed the car his girlfriend’s son was driving downtown, then lost control of his vehicle and left Main Street, causing a large amount of damage to Celebration Plaza, officers alleged in Beachem’s 2018 arrest reports.

Jail records show Beachem has an extensive criminal history dating back to 1989 that includes prior burglary, unauthorized use of a vehicle and assault arrests.

Beachem allegedly lost control of his vehicle on Main Street, causing a large amount of damage to the downtown square, then ran from police. He was found hiding in a group of shrubs, police noted in arrest reports following Beachem’s arrest August 12, 2018.

Beachem was indicted on the aggravated assault charge in late August 2018. He received 10 years on probation in November 2018, according to court records.

Because Beachem was still on probation during his arrest this week for burglary of a habitation, evading arrest or detention with a vehicle and unauthorized use of a vehicle, officials sought and obtained a warrant August 29th 2019 for violation of probation, police investigators reported.

Beachem remained in the county jail on $175,000 bond on the three charges Thursday afternoon, August 29. Police served him at the jail with the warrant for violating probation. Bond was denied on the warrant, according to police and jail reports.

Justin Arley Bryant, the Sulphur Springs man accused of holding his girlfriend at gunpoint in June to prevent her from breaking up with him, is back in the county jail.

Hopkins County Sheriff’s Sgt. Richard Greer and Chief Investigator Corley Weatherford located the 20-year-old man at his residence. They took him into custody at 12:53 p.m. Thursday, Aug. 29, on a motion to hold-bond insufficient, according to arrest reports.

Bryant was arrested June 27 at Buford Park. He was alleged to have engaged in a verbal argument with a 19-year-old Sulphur Springs woman about them ending their relationship. During the altercation, he allegedly retrieved a small black gun and pointed it at the female, “telling her that she can’t leave him,” Sulphur Springs Police Officer Nick Floyd noted in arrest reports. While shouting at the woman, Bryant allegedly pointed the weapon out an open window and discharged the firearm, police reports noted.

The woman reportedly talked him into going to play volleyball at the park and to get something to eat. Bryant allegedly put the gun away and they proceeded to the park. Another person contacted police about the situation, Floyd wrote in June 27 arrest reports.

Bryant was released from Hopkins County jail July 3 on $200,000 bond. Deputies took him into custody at his residence Aug. 29 on the insufficient bond charge. He remained in jail Friday morning, Aug. 30. The new bond on the aggravated assault with deadly weapon charge was set at $1 million, according to jail and arrest reports.
